1. Introduction

These Terms and Conditions govern the use of our Pooper Scooper service (the "Service"). By booking our services, you ("the Customer") agree to these Terms and Conditions. Please read them carefully.

These Terms and Conditions form a contract between you and Pooper Scoopers Limited, a UK-based pooper scooper service.

2. Booking and Scheduling

  • Booking Process: To book a service, you can sign up via our website, email, or phone. You will receive a confirmation once your service is scheduled.

  • Service Frequency: Our service is available on a twice-weekly, weekly, bi-weekly, monthly or one-time basis. The frequency of service should be agreed upon at the time of booking.

  • Access to Property: The Customer must ensure that the Pooper Scooper Pro has access to the garden or property at the scheduled time. If we cannot access your property due to gates being locked or other obstacles, a rebooking charge may apply.

3. Pricing and Payment

  • Pricing Structure: The price of our services will be agreed upon during the booking process and will depend on factors such as the size of the garden, the number of dogs, and the frequency of visits.

  • Payment Terms: Payment is due prior to the completion of the service, unless otherwise agreed. Payments will be made via direct debit which will be set up before our first visit.

  • Late Payment: Late payments may incur an additional charge. If payment is not received within 5 days of the invoice date, we reserve the right to suspend or cancel the service until payment is made in full.

4. Cancellation and Rescheduling

  • Cancellation Policy: If you need to cancel or reschedule a service, we require at least 24 hours' notice. Cancellations made with less than 24 hours' notice may incur a cancellation fee of 50% of the scheduled service cost.

  • Failure to Reschedule: If we arrive for a scheduled service and cannot access your property due to a locked gate or other obstacles, we may charge a rebooking fee or reschedule the service at your convenience.

5. Customer Responsibilities

  • Safe Environment: The Customer agrees to ensure that the garden or property is safe for our team to work in. This includes removing any hazards (e.g., sharp objects, dangerous plants) and ensuring that pets are safely contained or kept inside if they may pose a risk to our team.

  • Aggressive Animals: If your dog shows signs of aggression or is known to be aggressive towards strangers, we request that they are kept inside during the service. For the safety of our team, we reserve the right to refuse service or reschedule if an aggressive pet is not contained.

6. Liability

  • Service Limitation: Our team will take reasonable care when performing the service, but we are not liable for any damage to property, fences, or landscaping that occurs during the performance of the service, unless caused by our negligence.

  • Health and Safety: While our team is trained to safely handle pet waste, the Customer agrees to hold us harmless from any health issues or allergic reactions that may arise from contact with pet waste.

  • Loss or Injury: Pooper Scoopers Limited is not liable for any injury or loss sustained by pets, customers, or any other third parties during the performance of our services unless directly caused by our negligence.

7. Service Limitations

  • Exclusions: We will not remove dog waste from areas that are inaccessible (e.g., heavily wooded areas, steep hills) or if the pet waste is buried or frozen and cannot be safely removed. Our team will notify you if certain areas of your property cannot be cleaned.

  • Weather Conditions: In the event of extreme weather conditions (heavy rain, snow, etc.), we may reschedule the service for safety reasons. You will be notified if this occurs, and no additional charges will apply.

8. Data Protection

We collect and process personal information only as necessary to provide our services, in accordance with the UK Data Protection Act 2018 and GDPR (General Data Protection Regulation). By signing up to our service, you consent to the collection and use of your personal information for the purposes of fulfilling the service, sending invoices, and communicating with you about our services.

9. Amendments to Terms and Conditions

Pooper Scoopers Limited reserves the right to update or modify these Terms and Conditions at any time. Customers will be notified of any changes through our website or email. The new Terms and Conditions will apply from the date of publication.

10. Termination of Service

  • Termination by Customer: The Customer may terminate service at any time by notifying us in writing (email or postal). No refund will be given for services already provided.

  • Termination by Pooper Scoopers Limited: We reserve the right to suspend or terminate the service if the Customer fails to comply with these Terms and Conditions or if the safety of our team is compromised.

11. Force Majeure

Pooper Scoopers Limited shall not be held liable for any failure or delay in the performance of the Service due to events beyond our reasonable control, including but not limited to weather conditions, natural disasters, accidents, or acts of terrorism.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these terms shall be resolved through mediation or, if necessary, through the courts of England and Wales.
